NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
This promotion is intended for eligible residents of Canada (excluding Quebec) and the United States. By entering, you agree to these Official Rules. Please read carefully.
Sponsor
The Sweepstakes is sponsored by Scotlynn Commodities Inc., a corporation registered under the laws of Ontario, with its registered address at 1150 Vittoria Rd, Vittoria, Ontario, Canada (“Sponsor”). Questions may be directed to info@scotlynn.com.
Sweepstakes Period
The Sweepstakes begins on July 8 at 5:59pm Eastern Time (“ET”) and ends on July 15th at 5:59pm ET (the “Sweepstakes Period”). Sponsor’s computer is the official timekeeping device for this Sweepstakes. Entries submitted outside the Sweepstakes Period will not be eligible.
Eligibility
The Sweepstakes is open to:
Legal residents of Canada (excluding the Province of Quebec) who have reached the age of majority in their province or territory of residence; and
Legal residents of the 50 United States and the District of Columbia who are at least 18 years of age, or the age of majority in their state of residence, whichever is greater.
The following individuals are NOT eligible to enter:
Employees, officers, and directors of Scotlynn Commodities Inc. and its parent companies, subsidiaries, affiliates, and related entities; and
Advertising and promotional agencies, prize suppliers, administrators, and any other parties directly involved in the development or administration of this Sweepstakes; and
Immediate family members (spouse, parent, child, sibling, and their respective spouses) or members of the same household as any employee, officer, or director of Scotlynn Commodities Inc.
Void in the Province of Quebec, outside of Canada and the United States, and wherever prohibited, taxed, or restricted by applicable law. All federal, provincial, state, and local laws and regulations apply. Entrants must be natural persons; entries submitted by companies, organizations, or automated means will be disqualified.
How to Enter
To enter the Sweepstakes during the Sweepstakes Period, complete ALL of the following steps on the applicable social media platform (Facebook, Instagram):
Step 1: Follow Sponsor’s official account @ScotlynnGroup on Instagram, @Scotlynn on Facebook.
Step 2: Like and tag a friend on the Sweepstakes Post
Each completed set of steps constitutes one (1) Submission. All Submissions must comply with the Guidelines and Restrictions in Section 5.
Entry Limits and Account Requirements
Limit one (1) Submission per person, per social media account, per platform, regardless of method of entry. Duplicate Submissions will be disqualified.
Multiple entrants are not permitted to share the same social media account. Any attempt to obtain additional entries through multiple accounts, identities, or registrations will void all entries by that individual.
Use of automated, robotic, or programmatic entry systems is prohibited and will result in immediate disqualification.
If you enter using a mobile device, standard data fees from your wireless carrier may apply.
Submissions will not be acknowledged or returned.
Sponsor is not responsible for lost, late, incomplete, illegible, or misdirected Submissions.
By entering, each entrant warrants that they are the sole and exclusive owner of their Submission and that the Submission does not infringe upon the rights of any third parties.
Important Notice Regarding Winner Notification via Direct Message
Potential winners may be contacted via direct message on the social media platform through which they entered. To ensure delivery of any such notification, entrants are encouraged to: (a) follow Sponsor’s official account on the applicable platform; and (b) ensure their privacy settings permit direct messages from accounts they do not follow. Failure to maintain accessible contact settings does not excuse a winner from the notification requirements in Section 10. Email notification is available as an alternative; see Section 10.
FTC Disclosure Requirement
All posts, comments, or Submissions made in connection with this Sweepstakes must include the hashtag #Sweepstakes or #Contest where required by applicable platform guidelines or the U.S. Federal Trade Commission’s Endorsement Guides (16 CFR Part 255). Sponsor’s promotional posts for this Sweepstakes will be similarly identified. Failure to include required disclosures where mandated may result in disqualification.
Alternative Method of Entry (No Purchase Necessary)
To enter without interacting with social media, mail a hand-written card including your full name, mailing address, email address, phone number, and the name of the Sweepstakes (“Diecast Sweepstakes”) to: Scotlynn Sweepstakes, 1150 Vittoria Rd, Vittoria, ON N0E 1W0. Mail-in entries must be received by July 15th Limit one (1) mail-in entry per person. No mechanically reproduced entries will be accepted.
Submission Guidelines and Content Restrictions
By entering, each entrant agrees that their Submission conforms to the following guidelines and restrictions. Sponsor reserves the right, in its sole discretion, to disqualify any Submission that fails to comply.
Submission Guidelines
Submissions must be primarily in English.
Submissions must be original content created by the entrant and directly relevant to the Sweepstakes theme.
Content Restrictions. Submissions must NOT:
Infringe upon or violate any copyright, trademark, privacy, publicity, or other intellectual property rights of any party;
Disparage Sponsor, Scotlynn Commodities Inc., or any other person or entity;
Contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;
Promote bigotry, racism, hatred, or harm against any group or individual or promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
Contain material that is unlawful or contrary to the laws or regulations of Canada, the United States, or any other applicable jurisdiction;
Be inconsistent with the brand values, image, or purpose of Scotlynn Commodities Inc.
Intellectual Property and User-Generated Content License
By submitting an entry, each entrant grants Sponsor a royalty-free, non-exclusive, irrevocable, perpetual, worldwide license to use, reproduce, modify, publish, display, distribute, and create derivative works from their Submission, in whole or in part, in any media or technology now known or hereafter developed, for any lawful purpose, including promotional and marketing purposes, without further notice, compensation, or attribution.
To the extent permitted by law, each entrant irrevocably waives all moral rights in and to their Submission in favor of Sponsor. Entrants represent and warrant that they have full authority to grant this license and waiver.
Acceptance of a prize constitutes each winner’s permission for Sponsor to use his or her name, city and province/state of residence, likeness, photograph, picture, portrait, voice, biographical information, and/or statements regarding the Sweepstakes or Sponsor for advertising and promotional purposes without further notice or additional compensation, except where prohibited by law.
Winner Selection and Odds
On or about July 16th, two (2) potential winners will be selected by random draw from the single combined pool of all eligible Submissions received from both Canadian and United States residents during the Sweepstakes Period. The draw will be conducted by Sponsor or a Sponsor-designated administrator using a certified electronic random number generator (or equivalent randomization software). If a third-party administrator conducts the draw, their name will be on file at Sponsor’s registered address upon request.
For clarity, the draw is not segmented by country. Both winners will be drawn from the same combined pool of eligible entries. Depending on the eligible entries received, it is possible that both winners are residents of the same country. Odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.
The draw will be final and binding in all matters relating to this Sweepstakes.
Skill-Testing Question (Canadian Residents)
As required by Canadian law, no prize will be awarded to a potential winner who is a Canadian resident unless and until that winner has correctly answered, without assistance, a time-limited mathematical skill-testing question administered by telephone or email at Sponsor’s discretion. The skill-testing question will consist of a multi-step arithmetic equation.
Because this Sweepstakes uses a single combined draw open to both Canadian and United States residents, the skill-testing question requirement will apply only to those potential winners who are Canadian residents at the time of selection. Potential winners who are United States residents are not subject to this requirement. Failure by a Canadian-resident potential winner to correctly answer the skill-testing question will result in disqualification and selection of an alternate winner from the eligible entry pool.
Prize(s)
There are two (2) prizes available in this Sweepstakes, one (1) awarded to each selected winner. Prize details are as follows:
Prize Description: one (1) 1/64th Scale Diecast Scotlynn Truck.
Approximate Retail Value (ARV) per prize: $150 CAD.
Total ARV (both prizes combined): $300 CAD.
Prizes are non-transferable. No substitution or cash redemption of prizes will be permitted, except at Sponsor’s sole discretion.
In the event of unavailability of any stated prize, Sponsor reserves the right to substitute a prize of equal or greater value.
All applicable federal, provincial, state, and local taxes, and any expenses not specifically stated as included, are the sole responsibility of the winner.
Limit one (1) prize per person during the Sweepstakes Period.
If a prize includes a gift card, the gift card issuer’s terms and conditions will apply.
Winner Notification and Prize Fulfillment
Both potential winners will be notified on or about July 16th. Sponsor will make reasonable attempts to contact each potential winner using the following methods, in order of preference:
Primary: by email at the address associated with the entrant’s social media account or provided at the time of entry; then
Secondary: by direct message or comment reply on the social media platform through which they entered.
Entrants are responsible for ensuring that the email address associated with their account is accurate and accessible. Sponsor is not responsible for undelivered notifications due to spam filters, inactive email accounts, or restrictive platform privacy settings.
Within five (5) business days of initial notification, each potential winner may be required to:
Sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release;
Correctly answer the skill-testing question (Canadian residents only);
Provide any required government-issued identification; and
Provide releases from any third parties appearing in their Submission, if applicable.
If a potential winner cannot be contacted within five (5) business days of the first notification attempt, fails to respond, fails to satisfy eligibility requirements, fails the skill-testing question (Canadian residents), declines the prize, or is otherwise found ineligible, that winner’s prize will be forfeited and an alternate winner may be selected from the remaining eligible entry pool (time permitting). No compensation will be given for a forfeited prize. This process applies independently to each of the two (2) winners.
Privacy and Use of Personal Information
Contest Administration
By entering the Sweepstakes, entrants consent to the collection, use, and disclosure of their personal information by Sponsor solely for the purposes of administering this Sweepstakes, verifying eligibility, notifying potential winners, and fulfilling prizes. This consent is a condition of entry and does not constitute consent to receive commercial electronic messages. Sponsor will handle this information in accordance with its Privacy Policy available at www.scotlynn.com/privacy.
Marketing Communications (Optional, Separate Consent)
Participation in this Sweepstakes does NOT constitute consent to receive commercial electronic messages or marketing communications from Scotlynn Commodities Inc. If you wish to receive marketing communications from Sponsor, you must provide separate, explicit consent by reaching out to info@scotlynn.com with subject line: Communications Opt-In. This consent is entirely voluntary and will not affect your eligibility to enter or win.
All personal data collected in connection with this Sweepstakes will be handled in compliance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), and applicable United States privacy laws. Entrants may withdraw consent for marketing communications at any time by contacting Sponsor at info@scotlynn.com or using the unsubscribe mechanism in any Scotlynn marketing email.
Release of Liability
BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AND WINNERS AGREE TO RELEASE AND HOLD HARMLESS SCOTLYNN COMMODITIES INC., ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, ADVERTISING AND PROMOTIONAL AGENCIES, PRIZE SUPPLIERS, ADMINISTRATORS, AND EACH OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASED ENTITIES”), FROM ANY AND ALL LIABILITY FOR LOSS, HARM, DAMAGE, INJURY, COST, OR EXPENSE WHATSOEVER, INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY, AND/OR DEATH, ARISING OUT OF OR IN CONNECTION WITH: PARTICIPATION IN THE SWEEPSTAKES; ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE; TECHNICAL FAILURES OF ANY KIND; OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT, OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION.
Limitation of Liability and Disclaimer of Warranties
IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF ACCESS TO OR USE OF ANY WEBSITE OR SOCIAL MEDIA PLATFORM ASSOCIATED WITH THE SWEEPSTAKES, OR THE SWEEPSTAKES ITSELF. THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OR EXCLUSIONS OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Additional Terms
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend this Sweepstakes at any time, for any reason, including if virus, bugs, unauthorized human intervention, fraud, or other causes beyond Sponsor’s control affect the administration, security, fairness, or proper conduct of the Sweepstakes. In the event of cancellation or suspension, Sponsor may select winners from all eligible entries received prior to the action taken by Sponsor.
Sponsor reserves the right to disqualify any individual found to be: tampering with the entry process or the operation of the Sweepstakes; using automated entry programs; attempting to undermine the legitimate operation of the Sweepstakes through cheating, hacking, or deception; or intending to annoy, abuse, threaten, or harass any entrant or Sponsor representative.
Sponsor is not responsible for Sweepstakes interruptions or prize fulfillment failures due to acts of God, acts of war, natural disasters, pandemics, or other causes beyond Sponsor’s reasonable control.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Governing Law and Jurisdiction
Canadian Residents
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules with respect to Canadian residents, or the rights and obligations of Canadian-resident entrants or Sponsor in connection with this Sweepstakes, shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to any conflict of law provisions. Any dispute arising out of or relating to this Sweepstakes by a Canadian-resident entrant shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario.
United States Residents
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules with respect to United States residents, or the rights and obligations of US-resident entrants or Sponsor in connection with this Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to any conflict of law provisions. Any dispute arising out of or relating to this Sweepstakes by a US-resident entrant shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, applying the laws of the State of Florida.
ENTRANTS WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION PROCEEDINGS AGAINST SPONSOR, TO THE EXTENT PERMITTED BY LAW.
Social Media Platform Disclaimer and FTC Compliance
THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH ANY SOCIAL MEDIA PLATFORM, INCLUDING BUT NOT LIMITED TO FACEBOOK, INSTAGRAM. Entrants are providing information to Scotlynn Commodities Inc., not to any social media platform. All questions or comments regarding the Sweepstakes should be directed to Sponsor at info@scotlynn.com, not to the social media platform.
All terms and conditions of the applicable social media platform apply. Sponsor complies with all applicable platform promotional guidelines and policies.
FTC Compliance: In accordance with the U.S. Federal Trade Commission’s Endorsement Guides (16 CFR Part 255), Sponsor will clearly identify all sponsored or promotional Sweepstakes posts using the hashtag #Sweepstakes or #Contest. Entrants whose Submissions are shared or promoted by Sponsor will be notified. Entrants are solely responsible for compliance with any disclosure obligations applicable to their own Submissions.
